Source: RegistryDate: 2016-04-06
On August 12, 2015, the Seminar of “Online Dispute Resolution” was jointly held in Hong Kong by “.SHANGBIAO” (dot trademark in Chinese) Domain Registry and Hong Kong International Arbitration Center (HKIAC).
Cai Weiping, Assistant Secretary General of HKIAC, Wu Yangyi, Operating President of China Region of “.SHANGBIAO” Domain Registry, Li Jiaxin, General Manager of International Business, and Guan Yibin, General Manager of Greater China of Corporation Service Company, attended the seminar as guest speakers, and made a discussion on how to find the solution to online and offline infringement as well as how can trademark brand group use “.SHANGBIAO” to strengthen the brand image. Representatives from Deacons, Hogan Lovells, Hong Kong Economic Times, and many brand enterprises of Hong Kong attended the seminar. Xie Da’an, Chief Executive Officer of HKIRC, also attended the seminar and delivered a speech.
Cai Weiping, Assistant Secretary General of HKIAC, pointed out that among numerous united domain name resolution cases, 83.8% are from “.com”, and only 6.1% of generic top level domain name cases are from new generic top level domain. So, the new generic top level domain can be more protective for enterprise brands in terms of Internet authentication in the future. It is agreed that using “.SHANGBIAO” as the globally generic top level domain can evidently lower trademark brand right holders’ risk of being infringed. Then, Wu Yangyi, Operating President of China Region of “.SHANGBIAO” Domain Registry, and Li Jiaxin, General Manager of International Business, introduced the development opportunity, chief value, and registration rule of “.SHANGBIAO” top level domain name, and demonstrated the related application. Guan Yibin, General Manager of Greater China of Corporation Service Company, pointed out that the domain name is not only a channel on the Internet, but also an identification of status and brand. A large number of phishing websites and scam websites have appeared, so enterprises may suffer economic loss in addition to infringement of status and brand. Enterprises should combine intellectual property with the Internet, to protect their brands. CSC provides supervising services in relation to trademark and domain name to clients of Huyi Global Hong Kong, to ensure the one-stop defense of intellectual property.
According to statistics of China Customs, in 2014, the amount of imports for consumer goods in China was RMB936.27 billion, increasing 14.9% as compared with the last year. The growth rate of imports for consumer goods is evidently faster than that of the overall imports. The overseas brand faces a new development opportunity for entering Chinese market. But the overseas brand also faces unprecedented challenges in Chinese market, especially in the Chinese market of an Internet era. Specifically speaking, the localization of the overseas brand is imperative because Chinese consumers take Chinese as their mother language. The current Internet domain name address system is separate from the offline brand logo, which makes it difficult for netizens and consumers to distinguish the official website of brand group from the fake ones. Thus, the promotion of brand enterprises in the market is adversely affected. It is a ticklish problem for many overseas brand enterprises to fight against the endlessly emerging brand infringement, counterfeit, and abuse on China’s Internet. The seminar is held to help enterprises find solutions to the above-mentioned problems, so it is popular among and paid attention to by numerous Hong Kong and overseas enterprises. Finally, in the interaction and exchange session, representatives and guest speakers actively discussed related issues.
